On amendments to some legislative acts of Ukraine concerning the jurisdiction of cases involving social payments

Verkhovna Rada of Ukraine resolves:

I. Amend the following legislative acts of Ukraine:

1. Part One of Article 15 of the Civil Procedure Code (Official Gazette of the Verkhovna Rada of Ukraine, 2004, NN 40 - 42, Art. 492) to read as follows:

1. The courts are considering a civil action case concerning:

1) protection of disturbed, unrecognized or disputed rights, freedoms or interests arising from civil, housing, land, family, labor relations;

2) disputes over the purpose of calculation, recalculation, implementation, delivery, receiving pension payments, social benefits to disabled citizens, payment of compulsory national social insurance and other social payments, social services, assistance, protection, benefits, nonessential equipment, rations or cash compensation for them;

3) other legal relations, except in cases where consideration of such cases is conducted under the rules of other legal proceedings.

2. Paragraph 3 of Article 18 of the Code of Administrative Procedure of Ukraine (Bulletin of the Verkhovna Rada of Ukraine, 2005, NN 35 - 37, Art. 446) deleted.

II. Concluding and Transitional Provisions

1. This Law shall come into force from the date of its publication.

2. After the entry into force of this Act, the administrative courts complete review of cases in which the proceedings were opened by paragraph 3 of Article 18 of the Code of Administrative Procedure of Ukraine. Administrative litigation, appellate and cassation complaints or submissions filed before the entry into force of this Act to the relevant administrative courts in administrative cases referred to paragraph 3 of Article 18 of the Code of Administrative Procedure of Ukraine, and on which the proceedings are not opened, forwarded by the courts of the relevant courts carrying out their review in civil proceedings.
